The General Counsel certifies that the regulation codified in this chapter is adopted under the authority of the Public Utilities Article, §§ 17-403 and 29-101, Annotated Code of Maryland, and the Environment Article, § 4-105, Annotated Code of Maryland. This chapter shall apply to all underground utility construction and associated maintenance involving land disturbance occurring within Montgomery and Prince George’s Counties, subject to the exemptions set forth in WSSC 11.30.040(c). This chapter shall constitute the minimum erosion and sediment control requirements and shall not be deemed a limitation or repeal of any other powers granted by state statute.
