(a) Human Resources Office.

(1) The Human Resources Office shall conduct all preemployment background checks for employees and job applicants (including applicants for internships), with the exception of those applicants applying for positions within the PHSD. If a pre-promotion or preemployment background check reveals material of significance sufficient to warrant disqualification from promotion or hire, the candidate will be notified and allowed to submit a response. Any final decision to disqualify notwithstanding the employee’s or applicant’s response shall be reviewed and approved by the Human Resources Director or designee. The Human Resources Director is responsible for complying with this policy.

(2) The four levels of background investigations conducted by HRO are:

(i) Basic. Includes criminal check and SSN verification only; applies to student intern candidates.

(ii) Standard. Includes education, criminal, SSN verification, employment, DMV records and professional references; licenses/certifications are also checked, as appropriate; applies to all employees.

(iii) Advanced. Includes all elements examined in a standard investigation plus a credit check; applies to all managerial candidates, Senior and Junior Internal Auditor hires, and all hires in the Finance and Procurement Offices.

(iv) Executive. Includes all elements examined in an advanced investigation as well as a review of civil court cases and a newspaper scan and social media scan (including but not limited to Internet search and Linked-In search); applies to all Team Chiefs, Office Directors, and equivalent or higher-level managers.

(b) Police and Homeland Security Division (PHSD).

(1) PHSD shall conduct appropriate background investigations for all applicants for positions or promotions within the PHSD, as well as WSSC contractors or vendors seeking access to its facilities and/or infrastructure. If a pre-promotion, preemployment or pre-access background check reveals material of significance sufficient to warrant disqualification from promotion, hire or access to Commission facilities and/or infrastructure, the candidate or contractor/vendor, as appropriate, will be notified and allowed to submit a response. Any final decision to disqualify notwithstanding the employee’s, applicant’s or contractor/vendor’s response shall be reviewed and approved by the WSSC Chief of Police or designee. The Chief of Police is responsible for complying with this process.

(2) The four levels of background investigations conducted by the PHSD are:

(i) Level I. Refers to the most intensive background investigations, which apply to all positions within the PHSD, including all WSSC police officers. Level I background investigations shall follow MPTC regulations and will result in a finding of either “material of significance” or “no material of significance.” A “material of significance” finding indicates there is possible disqualifying information regarding the employee or job applicant. A “no material of significance” finding indicates there is no possible disqualifying information. Disqualifying information is that information which a reasonable person would believe adversely impacts the employee’s or job applicant’s ability to meet the job requirements or increases the likelihood that the employee’s or job applicant’s behavior will subject the Commission to unacceptable risk. Use of truth verification devices shall be limited to Level I investigations, which may include the following elements:

1. Credit check.

2. Criminal records check (online and known fingerprints).

3. Driving history check.

4. Educational records.

5. Personal references.

6. Employment history.

7. Military history check.

8. Coworker interviews.

9. Neighborhood canvass.

10. Civil complaint history.

11. Reappointment history/prior law enforcement history.

12. Records and information release waiver by the applicant.

13. Truth verification device examination.

14. Medical evaluation, to include drug screening.

15. Psychological evaluation (police officers only).

(ii) Level II. Refers to standard background investigations required by contractual agreement for WSSC contractors or subcontractors who require access to either Commission facilities and/or infrastructure, or engineering plans, drawings, or other records, or other information the Commission deems sensitive. WSSC Contract Managers have the responsibility for ensuring that PHSD conducts and concludes background investigations for contractors and vendors requiring access to Commission infrastructure and/or facilities in connection with contracts for which a specific Contract Manager is responsible. The WSSC’s contractor database contains background investigation results for contractors and associated vendors. PHSD shall report Level II background investigations as either “approved” or “not approved for security reasons.” Level II background investigations may include the following elements:

1. Driving history.

2. Criminal history.

3. Professional references.

4. Employment history.

5. Credentials check (relevant professional certifications and licenses).

(iii) Level III. Refers to background investigations utilized when an individual, on behalf of a legitimate business entity, applies for access to WSSC engineering plans, drawings, or other records, or other information the Commission deems sensitive, for the purpose of bidding on Commission contracts. Please reference WSSC Chapter 1.10 (Access to Sensitive Engineering Records) for related information. PHSD shall report Level III background investigations as either “approved” or “not approved.” Level III background investigations may include the following elements:

1. Public records check.

2. Requestor interview.

3. Company official interview.

4. WSSC contact check.

5. WSSC prior history check.

6. Business licensing verification.

7. Professional reference check.

(iv) Level IV. Refers to background investigations utilized when an individual, whether a private citizen or a public or private sector employee or contractor, applies for access to WSSC engineering plans, drawings, or other records, or other information the Commission deems sensitive. The purpose of this background investigation is to verify the individual requestor and/or his organization’s identity, and his or its legitimate need for engineering information. Please reference WSSC Chapter 1.10 (Access to Sensitive Engineering Records) for related information. PHSD shall report Level IV background investigations as either “approved” or “not approved.” Level IV background investigations may include the following elements:

1. Public records check.

2. Requestor interview.

3. Company official interview.

4. WSSC contact check.

5. WSSC history check.
