(a) Policy. In cases where two or fewer bids or proposals are submitted or where the submitted price or cost is not based on established catalogue or market prices, the Chief Procurement Officer or designee may request factual information reasonably available to the bidder or offeror to substantiate that the price or cost offered, or some portion of it, is reasonable.

(b) Submission of Substantiating Data.

(1) Time and Manner. When factual information is requested by the Procurement Officer to substantiate that the price or cost offered, or some portion of such price or cost, is reasonable, the bidder or offeror shall submit such data to the Procurement Officer prior to beginning price negotiations at any reasonable time and in any reasonable manner prescribed by the Procurement Officer. Such information shall either be actually submitted or specifically identified in writing.

(2) Refusal to Submit Data. A refusal by the bidder or offeror to supply the requested information may be grounds to disqualify the bidder or offeror or to defer award pending further review and analysis. (Procurement regulations § 4-403, dated August 1, 2012)
