(a) If significant changes to the utility erosion and sediment control plan become necessary during construction, this will be accomplished through issuance of a change order. Since the utility erosion and sediment control permit cites and incorporates the requirements of the utility erosion and sediment control plan, this will constitute a permit revision as well. The requirements of the revised permit and plan will then be enforced by the Engineering and Environmental Services Division.

(b) The Engineering and Environmental Services Division shall issue violation notices to the field representative of the permittee with a copy to the Commission’s field representative for noncompliance with the approved utility erosion and sediment control plan and permit.

(c) Upon receipt of the violation notice, the Pipeline Construction Division shall issue a field order to the contractor to comply with the provisions of the violation notice. The field order shall be issued within 24 hours of issuance of the violation notice.

(d) If the permittee fails to comply with the provisions of the violation notice and associated field order, the Engineering and Environmental Services Manager may suspend the issued utility erosion and sediment control permit. Upon suspension of this permit, the Engineering and Environmental Services Division Manager shall immediately notify the Pipeline Construction Division Manager of the permit suspension.

(e) At the time of notification of permit suspension, the appropriate Pipeline Construction Division Manager shall issue a field order to the contractor instructing him/her to stop work on all construction except for actions to correct the erosion and sediment control violation. The field order shall be issued within 24 hours of the notice of permit suspension and shall be in effect until the notice of suspension is lifted by the Engineering and Environmental Services Division Manager.

(f) At the time of compliance with the violation notice, the Engineering and Environmental Services Division Manager shall lift the permit suspension and verbally notify the Pipeline Construction Division Manager.
