(a) Application.

(1) An employee seeking outside employment shall submit the designated request form through the employee’s chain of command to the appropriate initial and second-level reviewers.

(i) For employees holding a position below the Division Manager level, the initial reviewer is the employee’s immediate supervisor and the second-level reviewer is the Division Manager.

(ii) For employees holding a position of Division Manager, Deputy or the equivalent, or who report directly to a Department Head, the initial reviewer is the Department Head and the second-level reviewer is the Deputy General Manager.

(iii) For direct reports of a Deputy General Manager, the initial reviewer is the Branch Deputy General Manager and the second-level reviewer is the General Manager/Chief Executive Officer.

(iv) The General Manager/Chief Executive Officer is the reviewer for employees that report directly to the General Manager/Chief Executive Officer and there is no second-level reviewer.

(v) For Commission direct reports, the reviewer is the Chair of the Commission and there is no second-level reviewer.

(2) The first-level reviewer shall review and comment on requests for outside employment regarding whether:

(i) There is a conflict between the working hours of the requested outside employment and the employee’s WSSC job;

(ii) There is a conflict of interest or the appearance of a conflict of interest;

(iii) The proposed employment is with a prohibited business and the Board of Ethics has not granted a waiver; or

(iv) There is any other reason why the secondary employment may not be appropriate.

(3) Forms that have completed the review process shall be forwarded to the Ethics Officer for approval.

(4) If an outside employment request is denied, the employee may seek an advisory opinion from the Board of Ethics.

(5) At any time during the approval process, a reviewer may request an advisory opinion from the Board of Ethics regarding the request for outside employment.

(b) Post-Approval Requirements.

(1) After outside employment is approved, employees shall keep the first-level reviewer informed of changes to the outside employment that may affect their WSSC position including changes in duties, different hours, or termination of the outside employment.

(2) Within 30 days of a change in duties or hours that may affect their WSSC duties or hours, the employee shall submit a new request form.

(3) 

(i) An employee who receives approval for outside employment and subsequently accepts another position with WSSC shall submit a new request form within 30 days of starting the new position at WSSC.

(ii) If the employee fails to reapply or is denied approval, the original approval shall terminate 30 days after the employee begins the new position. (Res. 2022-2306)
